These Terms govern your use of Better Listings ("the Service"), operated by Better Listings, operated from Sweden ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

Better Listings is an AI-powered tool that cleans up product photos and generates marketplace listings (titles, descriptions, tags) for resellers on platforms such as Poshmark, Depop, eBay, Vinted and Mercari.

2. Acceptance & Authority

By using the Service you confirm that you are of legal age in your jurisdiction and, if acting on behalf of a business, that you have authority to bind that business.

3. Account & Credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Provide accurate information and keep it updated.

4. Acceptable Use

You agree not to misuse the Service. In particular you must not:

• Use the Service for unlawful purposes, fraud, or spam;
• Upload content you do not have rights to, or content that infringes the IP rights of others;
• Generate or process images that depict minors inappropriately, sexual content involving real persons without consent, hate speech, deepfakes intended to deceive, or other harmful content;
• Attempt to interfere with the security or integrity of the Service (malware, probing, scraping, reverse engineering);
• Resell, redistribute, or sublicense the Service.

5. AI-Generated Output

The Service uses AI models to clean photos and write listings. You are responsible for: (a) the prompts and notes you provide, (b) verifying the accuracy of titles, descriptions and tags before posting them publicly, and (c) ensuring you have rights to all input photos. AI output may contain inaccuracies and is not a substitute for your own review. We may moderate, filter, or refuse to process content that violates these Terms.

6. IP Rights

We retain all rights in the Service, our software, branding and documentation. You retain ownership of the photos and content you upload, and the cleaned photos and listing text generated for you. You grant us a limited license to host and process your content solely to provide the Service.

If you believe content on the Service infringes your rights, contact us — we will review and may remove infringing content and terminate accounts of repeat infringers.

7. Credits, Subscriptions & Payment

The Service is offered as one-time credit packs and as a recurring "Pro" subscription that unlocks unlimited use. Credits do not expire. Subscriptions renew automatically until cancelled. You can cancel at any time through the customer portal; cancellation takes effect at the end of the current billing period.

Our order process is conducted by our online reseller Paddle.com Market Limited. Paddle is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. For payment, billing, tax, cancellation, and refund mechanics please also refer to Paddle's Buyer Terms.

8. Service Level

We provide the Service on a best-effort basis. We do not guarantee uninterrupted, error-free, or perfectly accurate output. We may modify, suspend, or discontinue features at any time.

9. Suspension & Termination

We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated/serious policy violations. On termination, your subscription will not renew and we will delete or anonymise your data within a reasonable period (you may request export beforehand).

10. Warranties & Liability

To the fullest extent permitted by law, the Service is provided "as is" without implied warranties of merchantability or fitness for a particular purpose. Our aggregate liability is capped at the fees you paid in the 12 months prior to the claim. We are not liable for indirect, consequential or special damages (including loss of profits, data, or goodwill). Nothing in these Terms excludes liability for fraud, death, or personal injury where prohibited by law.

11. Indemnity

You agree to indemnify us against claims arising from content you upload, your unlawful use of the Service, or your breach of these Terms.

12. Changes

We may update these Terms; continued use after changes are posted constitutes acceptance. Material changes will be notified via email or in-app.

13. Governing Law & Disputes

These Terms are governed by the laws of the seller's jurisdiction. Disputes will be resolved in the competent courts of that jurisdiction.
